Agreement to These Terms
These Terms of Service ("Terms") govern your use of The Recipe Organizer mobile application and website (together, the "Service"), operated by The Recipe Organizer ("we," "our," or "us"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Your use of the Service is also governed by our Privacy Policy, which explains how we handle your information.
Eligibility
You must be at least 13 years old to use the Service. By using it, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please provide accurate information when registering and keep it current. Notify us promptly at support@therecipeorganizer.com if you believe your account has been accessed without your permission.
You may delete your account at any time. Deletion of your account and associated data is described in our Privacy Policy.
Your Content
The Service lets you create, import, edit, organize, and store recipes, notes, tags, photos, and other material ("Your Content"). You retain ownership of Your Content. We do not claim any ownership interest in it.
To operate the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, and display Your Content solely for the purpose of providing the Service to you and to the people you choose to share it with. This licence exists only so that we can run the Service; it ends when you delete Your Content or your account, except for content you have shared with others, which is addressed below.
You are responsible for Your Content. You represent that you have the necessary rights to it and that it does not infringe the rights of any third party or violate any applicable law.
Sharing and Community Recipes
The Service allows you to share recipes with specific people, and to publish recipes to a shared community collection. Please be aware of what sharing means:
- When you share a recipe with another person, they may be able to view it and, where you permit it, save their own copy or share it onward.
- A copy that another person has saved is their copy. Deleting your original recipe or your account does not delete copies that others have already saved.
- When you publish a recipe to the community collection, you make it visible to other users of the Service, and you grant those users the ability to view and save it.
- You can stop sharing a recipe or withdraw resharing permission at any time, which prevents future access, but it cannot retrieve copies already saved.
Do not share content you do not have the right to share. Only publish recipes to the community collection if you are comfortable with them being seen and saved by others.
Importing Content From Other Sources
The Service includes tools that let you import a recipe from a web page or a social media post that you provide. These tools act on your instruction, as a convenience for organizing recipes you have found. When you import content:
- You are responsible for ensuring you have the right to save and use that content for your own personal, non-commercial purposes.
- We display attribution to the original source and creator where that information is available, and we link back to the original post or page.
- Imported material remains the property of its original creator. Nothing in the Service transfers ownership of anyone else's recipe or photograph to you or to us.
- You must comply with the terms of the platform the content came from, in addition to these Terms.
We are not affiliated with, endorsed by, or sponsored by any third-party platform from which content may be imported. Trademarks and content belonging to those platforms remain the property of their respective owners.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, or to infringe anyone's intellectual property or privacy rights
- Upload or share content that is harassing, hateful, deceptive, obscene, or otherwise objectionable
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
- Interfere with, disrupt, or place undue load on the Service or its infrastructure
- Scrape, harvest, or bulk-extract data from the Service by automated means
- Resell, sublicense, or commercially exploit the Service or content belonging to other users
- Reverse engineer or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by law
Recipes, Nutrition, and Food Safety
Recipe content is provided for general informational purposes only. Recipes on the Service are created by users or imported from third-party sources at a user's direction. We do not test, verify, or endorse them.
Nutritional values, cook times, servings, ingredient lists, and allergen information may be generated automatically or parsed from external sources and may be inaccurate or incomplete. Do not rely on the Service for dietary, allergen, medical, or food-safety decisions. Always verify ingredients independently if you have an allergy or dietary restriction, and follow safe food handling and cooking practices. If you have health concerns, consult a qualified professional.
Advertising
The Service is supported in part by advertising, including ads served through Google AdMob. By using the Service you agree that we may display advertisements. How advertising data is handled is described in our Privacy Policy.
Third-Party Services and Links
The Service relies on third-party providers and may contain links to third-party websites and content. We do not control those services and are not responsible for their content, policies, or practices. Your use of a third-party service is governed by that party's own terms.
Our Intellectual Property
The Service itself, including its software, design, text, graphics, and the name and logo of The Recipe Organizer, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our name, logo, or branding without our prior written permission.
Copyright Complaints
We respect intellectual property rights. If you believe content on the Service infringes your copyright, please contact us at support@therecipeorganizer.com with a description of the work, the location of the material on the Service, your contact information, and a statement that you have a good faith belief the use is not authorized. We will investigate and may remove the material and, in appropriate cases, terminate repeat infringers.
Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if continuing to provide the Service to you would create legal or security risk. Where reasonably practicable we will give you notice.
Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and governing law — will survive.
Service Availability and Changes
We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, error-free, or that data will always be available. You are encouraged to keep your own copies of recipes that matter to you.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will meet your requirements, that it will be secure or uninterrupted, or that any content, including recipe or nutritional information, is accurate or reliable.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RECIPE ORGANIZER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR RECIPES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In those cases our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify and hold harmless The Recipe Organizer and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms or of any third-party rights.
Governing Law and Venue
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts. This does not deprive you of any protection afforded by mandatory law in your country of residence.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page, and where the changes are material we will make reasonable efforts to notify you. Continuing to use the Service after the changes take effect means you accept the revised Terms.
Severability and Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, form the entire agreement between you and us regarding the Service.
